Release & Waiver of Liability

Ride the Rim E-bikes, LLC

Twin Falls, Idaho 83301

This Release & Waiver of Liability ("Release") must be signed in person before any rider takes possession of a Class 2 electric bicycle ("E-bike") or related equipment from Ride the Rim E-bikes, LLC. It supplements the Rental Agreement accepted at checkout.

Each rider age 18 or older signs for themselves. For any rider ages 14-17 (a "Minor Rider"), the rider's parent or legal guardian signs on the rider's behalf and must also be renting, riding, and present throughout the rental.

1. Eligibility & Helmet

I am at least 14 years of age. If I am under 18, my parent or legal guardian is signing this Release for me and is renting, riding, and present with me for the entire rental. A helmet has been provided, and I agree to wear it at all times while operating the E-bike.

2. No Riding Under the Influence

I will not operate the E-bike while under the influence of alcohol, cannabis, or any drug or medication that impairs my ability to ride safely.

3. Assumption of Risk

I understand that operating an E-bike is inherently dangerous and I expressly assume all risks, known and unknown, of participating. These risks include but are not limited to death, paralysis, severe bodily injury, head injuries, broken bones, cuts, scrapes, loss of control, falling, collisions, terrain hazards, equipment damage, injury to or caused to others, and negligent acts of other riders, persons, vehicles, property owners, or third parties.

4. Release & Waiver of Liability

In consideration of being permitted to rent and use the Equipment, I release, waive, and forever discharge Ride the Rim E-bikes, LLC and its members, managers, agents, employees, volunteers, and affiliates from claims for injury, death, loss, or property damage arising out of or related to the rental and use of the Equipment, including claims based on ordinary negligence. This release does not extend to gross negligence or willful misconduct.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Releasees from claims, suits, damages, judgments, and costs arising out of the use of the Equipment or breach of this Release or the Rental Agreement.

6. General Terms

This Release is governed by Idaho law. If any portion is found invalid or unenforceable, the remaining portions remain in full force and effect. This Release is entered voluntarily and remains in effect for the initial rental and all subsequent rentals from the Company.

Signatures

Every rider must be listed and signed for. Adult riders sign their own block. Each Minor Rider (14-17) must have a parent or legal guardian sign the guardian block, and that guardian must also be a rider on this reservation.
