Ride the Rim E-bikes, LLC
These Terms of Service ("Terms") govern your use of https://ridetherimebikes.com (the "Site"), operated by Ride the Rim E-bikes, LLC ("we," "us," "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About the Site
The Site provides information about our electric-bicycle rentals and lets you make reservations through our booking system. Booking and payment functions are provided through Booqable, our third-party rental-management platform, and a third-party payment processor.
2. Rentals Are Governed by Separate Agreements
These Terms cover your use of the Site only. Your rental of any e-bike is governed by our separate Rental Agreement, which you accept at checkout, and our Release & Waiver of Liability, which each rider (or a parent/guardian for a minor rider) signs in person before equipment is released. In the event of a conflict regarding a rental, those documents control over these Terms.
3. Eligibility
You must be at least 18 years old to make a reservation or enter a binding agreement through the Site. Age and supervision requirements for actually riding are set out in the Rental Agreement and Release & Waiver.
4. Pricing, Bookings, and Payment
Prices, availability, deposit amounts, and policies shown on the Site may change and are confirmed at the time of booking. Reservations, security-deposit holds, cancellations, and refunds are handled according to the Rental Agreement and processed through our booking and payment providers. We may decline or cancel a reservation where necessary.
5. Acceptable Use
You agree not to: use the Site for any unlawful purpose; interfere with or disrupt the Site or its security; attempt to gain unauthorized access to any system or account; scrape, copy, or harvest content or data except as normally permitted by a browser; or submit false, misleading, or fraudulent booking information.
6. Intellectual Property
The Site and its content, including text, logos, graphics, and images, other than third-party or customer content, are owned by or licensed to Ride the Rim E-bikes, LLC and are protected by applicable law. You may not copy, reproduce, or use them without our permission, except for personal, non-commercial use of the Site as intended.
7. Third-Party Services and Links
The Site relies on and may link to third-party services, including Booqable and our payment processor. We are not responsible for the content, practices, or availability of third-party services, and your use of them is subject to their own terms and privacy policies. Booking is provided through Booqable and payments are processed through Stripe; we do not control and do not guarantee the availability, uptime, or uninterrupted operation of these services, and we are not liable for any delay, error, or loss arising from their unavailability.
8. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on it is accurate or current. This Section concerns the Site; risks associated with e-bike riding are addressed in the Release & Waiver.
9. Limitation of Liability
To the fullest extent permitted by law, Ride the Rim E-bikes, LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of or inability to use the Site. Nothing in these Terms limits liability that cannot be limited under applicable law. Liability arising from rentals is governed by the Release & Waiver and Rental Agreement.
10. Indemnification
You agree to indemnify and hold harmless Ride the Rim E-bikes, LLC from any claims, damages, or costs (including reasonable attorney's fees) arising out of your misuse of the Site or breach of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Any dispute relating to the Site will be brought in the state or federal courts located in Idaho.
12. Changes to These Terms
We may update these Terms from time to time. The "Effective date" above shows when they were last revised, and continued use of the Site after changes are posted means you accept the revised Terms.
