E-Bike Rental Agreement
Ride the Rim E-bikes, LLC
This Rental Agreement ("Agreement") is entered into between Ride the Rim E-bikes, LLC ("Company," "we," "us") and the person who books and accepts the reservation at checkout (the "Responsible Party," "you"). A reservation may cover one or more electric bicycles for one or more individual riders ("Riders").
The Responsible Party assumes full, primary, and personal responsibility for the entire reservation and for every Rider in the group. The Responsible Party agrees to be liable for all amounts and obligations arising from the reservation, including rental charges, taxes, extensions, late fees, deposits, and all damage to or loss of Equipment.
Each Rider, or for any Rider under 18, that Rider's parent or legal guardian, must sign the separate Release & Waiver of Liability in person before any Equipment is released.
1. Rental & Equipment
The Company agrees to rent one or more Class 2 electric bicycles ("E-bike"), throttle- or pedal-assisted with motor assistance ending at 20 mph, together with any helmet or other items provided (collectively, the "Equipment"). Each Rider accepts the Equipment in "as-is" working condition.
2. Rental Period & Rate
The rental rate is $25.00 per hour, plus applicable Idaho sales tax. The rental period begins when the Rider takes possession of the Equipment and ends when all Equipment is returned to the Company. A grace period of 15 minutes is allowed; after that, late returns are billed at $30.00 per hour or part thereof, plus tax.
Extensions. A rental may be extended if Equipment is available. Extensions are billed at the hourly rate plus applicable Idaho sales tax and charged to the payment card on file.
3. Security Deposit
A $100.00 security deposit is required and will be placed as a hold on the Responsible Party's payment card. The deposit will be released after the Equipment is returned undamaged, complete, and on time, less any amounts owed. Holds on cards entered online release automatically within 7 days, per the card processor's authorization window.
4. Cancellation
Reservations cancelled at least 24 hours before the rental start time receive a full refund. Cancellations within 24 hours, no-shows, and early returns are non-refundable.
5. Rider Eligibility
The Responsible Party must be at least 18 years of age. Riders ages 14-17 may ride only when a parent or legal guardian is also renting, riding, present for the entire rental, and signs the Release & Waiver of Liability on the minor's behalf. No Rider under 14 is permitted.
6. Proper Use & Rules
Riders must ride safely, obey Idaho laws and posted rules, wear a provided helmet at all times, keep the Equipment clean and in good working condition, and ensure that only listed Riders covered by a signed waiver operate the Equipment.
7. Prohibited Use; No Riding Under the Influence
The Rider shall not operate the E-bike while under the influence of alcohol, cannabis, or any drug or medication that impairs the ability to ride safely.
8. Damage, Loss & Group Responsibility
The Responsible Party is responsible for all damage to or loss of any Equipment in the reservation during the rental period, including theft and damage caused by any Rider in the group. The Responsible Party authorizes the Company to keep their payment card on file and to charge that card for repair or replacement costs, rental extensions, late fees, and unreturned Equipment.
9. General Terms
This Agreement is governed by Idaho law. If any portion is found invalid or unenforceable, the remaining portions remain in full force and effect. This Agreement, together with the signed Release & Waiver of Liability, constitutes the entire agreement between the parties.
10. Acceptance
By checking the box at checkout marked "I have read and agree to the Ride the Rim E-bikes Rental Agreement," the Responsible Party acknowledges that they have read and understood this Agreement and accept it knowingly and voluntarily.
